These Terms & Conditions ("Terms") govern your use of thenowdesigns.com and the services provided by The Now Designs ("we", "us", "our"). By using the Site or purchasing a plan, you agree to these Terms.
The Now Designs provides web design, brand identity, development, and related growth/marketing services. The specific scope, deliverables, and timeline for any project will be agreed with you directly before work begins.
To deliver your project, we may need timely content, feedback, approvals, and access from you. Delays in providing these may affect timelines. You confirm that any materials you give us (logos, images, copy) are yours to use or properly licensed.
Each plan includes a reasonable, agreed number of revisions. Work beyond the agreed scope may be quoted separately before it is carried out.
Upon full payment, ownership of the final deliverables created specifically for you transfers to you. We retain ownership of any pre-existing tools, frameworks, and components we use to build them, and we may showcase completed work in our portfolio unless you ask us in writing not to.
You can cancel a monthly plan at any time to stop future billing. Because our work is custom and time-based, fees for work already performed are generally non-refundable. If something isn't right, contact us — we'll work to make it right.
The Site and our services are provided "as is." While we build to a high standard, we do not guarantee specific business results, search rankings, or revenue outcomes.
To the maximum extent permitted by law, The Now Designs is not liable for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount you paid us for the service giving rise to the claim.
Either party may end an ongoing engagement with reasonable notice. Outstanding fees for work completed remain payable.
These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Washington.
We may update these Terms from time to time. Continued use of the Site or services after changes are posted means you accept the updated Terms.
